Local Law 196 was approved and passed. What is Local Law 196?

From March the 1st, 2018, Local Law 196 (LL196) requires safety training for all demolition and construction workers employed within the Five Counties. All the projects required a Construction Supervisor, Site Security Manager, Site Security Coordinator, Concrete Security Manager, or Competent Person. Ultimately, all workers must complete a minimum of 40 hours of security-related training and obtain a Site Safety Training Card (SST) to be eligible to work on construction sites in New York City. Supervisors will be required to complete 62 hours of security-related training to obtain a supervisor SST card.

Who does LL196 apply to?

Construction or demolition workers and supervisors (site security managers, site security coordinators, concrete security managers, construction superintendents, and competent persons) at job sites must designate a construction superintendent, site security coordinator, or site security manager must be trained.

*Below you can find a list of examples of workers who require and do not require training, as designated by the DOB.

LL196 dates to remember

March the 1st 2018, was the first compliance milestone date; All demolition and construction workers must complete one of the following courses:

  • 10-hour OSHA course
  • 30-hour OSHA course
  • 100-hour training program

December 1st 2019, all workers must have a temporary SST card, limited SST card, or SST card.
December the 1st 2019, all Construction Superintendent, Site Security Manager, Site Security Coordinator, Concrete Security Manager, Competent Person must have an SST Supervisor Card.
On or before September the 1st 2020, all workers must have an SST card.

Worker requirements for obtaining an SST card

Temporary OSHA card

For new demolition or construction workers who have completed OSHA for 10 hours. The card expires after 6 months. During this time, workers must complete the training to receive a limited SST card or SST card.

Limited OSHA card

Workers who cannot yet accomplish the full LL196 requirements but have completed any of the following courses will have a limited SST card that will expire but will not be renewable:

10-hour OSHA, plus 20 additional OSHA credits including:
  • 8-hour fall prevention
  • Chapter 33 of 8 hours (Site Security Manager Update)
  • Scaffolding user with 4-hour support
30-hour OSHA course:
  • 100-hour training program (such as approved learning)
  • Previous experience *
  • 4-hour fall prevention for scaffolding user with 4-hour support The limited card expires and is not renewable.

Requirements for SST card.

SST 40 Hr card

Workers who have fully satisfied one of the following courses will obtain the card:

10-hour OSHA, plus 30 additional OSHA credits including:
  • 8-hour fall prevention
  • Chapter 33 of 8 hours (Site Security Manager Update)
  • Scaffolding user with 4-hour support
  • 4-hour general electives
  • Specialized 4-hour electives
  • 2-hour drug and alcohol awareness
30-hour OSHA, plus an additional 10 hours of OSHA consisting of:
  • 8-hour fall protection course
  • 2-hour drug and alcohol awareness seminar
  • 100-hour training program

* Workers who have the required 40 hours of SST training before September 1st 2020, can get an SST card instead of a limited SST card.

This card will be valid for a period of 5 years and will require 8 hours of SST training to renew.

Requirements for supervisor SST card.

Requirements for supervisor SST card

Construction Superintendents, Site Security Manager, Site Security Coordinators, Concrete Security Managers or Competent Person who have completed 62 OSH credits including:

  • 30-hour OSHA,
  • 8-hour fall protection course
  • 8-hour upgrade training for the site security manager
  • Training for scaffolding users with 4-hour support
2 hours of each of the following topics:
  • Site Security Plans o Toolbox Talks
  • Pre-task meetings o General Electives
  • Specialized electives
  • Awareness of drugs and alcohol

* Supervisors who have the required 62 hours of SST training before September 1, 2020, can obtain an SST card in place of a limited SST card.
This card will be valid for a period of 5 years and requires 16 hours of SST training to renew.

What if I’ve received training in the past?

Course equivalents allow workers and supervisors who have taken DOB approved training courses in the past to use those training hours as Site Safety Training credits as long as they are listed on the DOB course equivalents table.

What are the risks of not completing OSHA training?

Licensed professionals and owners must certify that workers have the required training. A DOB inspector may impose fines of up to $15,000 per un-skilled worker:

$ 5,000 for the owner
$ 5,000 for the Licensed professional
$ 5,000 for the employer

The law also requires permit holders to record skilled workers or face fines of up to $2,500.
The DOB plans unannounced site checks where untrained workers have been found and will target licensees who have committed past violations!
